Section 150.15 of the Warrick County Code requires a valid building permit from the Building Commissioner before construction begins on any structure, expressly listing 'an in-ground swimming pool' and 'an above ground swimming pool deeper than three and one-half feet' among the improvements that trigger the requirement regardless of cost, alongside hot tubs and spas. The Building Commissioner issues the permit under Section 150.21 once a complete application, including plot plan and specifications required by Section 150.16, is submitted and the project will not violate other applicable laws.

Section 150.17's residential fee schedule, approved by the County Commissioners effective April 7, 2003, sets the fee for a residential in-ground pool at $100 and for a residential above-ground pool deeper than three and one-half feet at $50; the commercial fee schedule sets an in-ground pool at $200. Section 150.40(A)(7) adopts Article 20, the Indiana Swimming Pool Code within Title 675 of the Indiana Administrative Code, by reference as a minimum construction standard, with copies on file with the clerk of the legislative body under I.C.

36-1-5-4. An above-ground pool three and one-half feet deep or shallower falls outside the Section 150.15 trigger and needs no building permit. Once installed, the pool remains subject to periodic inspection by the Building Commissioner under Section 150.30, and occupancy tied to a structural improvement is not final until any required certificate of occupancy issues under Section 150.22.
