All swimming pools in unincorporated San Diego County must comply with the California Swimming Pool Safety Act and County Code Section 92.1.3109.3. At least one approved safety feature must be inspected before the pool is filled. Pools include in-ground, above-ground, and wading pools over 18 inches deep.
County Code Section 92.1.3109.3 and the California Swimming Pool Safety Act (Health & Safety Code Β§115920-115929) require comprehensive pool safety measures. A swimming pool includes in-ground, above-ground, and on-ground pools and fixed-in-place wading pools containing water over 18 inches deep. At least one nonredundant safety feature must be inspected and approved prior to plastering or filling. Approved features include: pool fencing meeting barrier requirements, approved safety pool cover (ASTM F 1346), pool alarm meeting ASTM standards, or self-latching devices on doors accessing the pool area. The California Building Code Section 3109 and the International Swimming Pool and Spa Code also apply.
Pool safety violations may result in citations, required corrections, and fines. Non-compliant pools cannot pass final inspection. Severe cases involving child safety may result in criminal negligence charges.
