All pool electrical systems must have GFCI protection and proper bonding. Pool equipment must comply with noise standards and not create nuisance conditions for neighbors. Encinitas's Development Services Department inspects pools at construction and can inspect existing pools upon complaint. Residential pool owners are responsible for ongoing compliance with safety standards. For real estate transactions, pool safety compliance is part of the transfer disclosure requirements.
Non-compliant drain covers must be replaced immediately. Pool safety violations are life-safety issues that may result in orders to cease pool use until corrections are made. Fines may apply for non-compliance.
