Residential pool and spa safety in Menifee is governed primarily by California's Swimming Pool Safety Act (Cal. H&SC §§115920-115929), which Menifee enforces through MMC Title 15 (adopting the California Building and Residential Codes). When a building permit is issued for a new pool/spa, or for a remodel that requires a permit, the project must include at least two of seven approved drowning-prevention safety features. Anti-entrapment drain covers compliant with the federal Virginia Graeme Baker Act (VGBA) are also required.
The seven approved features under H&SC §115922(a) are: (1) an isolation enclosure meeting §115923; (2) removable mesh fencing per ASTM F2286 with a self-closing/self-latching gate; (3) an approved safety pool cover meeting ASTM F1346; (4) exit alarms on doors and windows that open to the pool area; (5) self-closing, self-latching devices on direct-access doors with a release at least 54 inches above the floor; (6) a water-surface alarm meeting ASTM F2208; or (7) other means of protection providing equal or greater protection certified by an independent testing laboratory. New pools/spas must also have anti-entrapment drain covers per the federal Pool & Spa Safety Act. CPR signage and lifeguard requirements only apply to public pools (Riverside County DEH oversight). PRC §4291 defensible space and CalGreen energy standards (pool heating) may also apply in Menifee's WUI overlay.
Permit final inspection will not be approved unless the two required drowning-prevention features are installed and verified. Operating a pool without compliant drain covers is also a federal violation. Civil liability for premises owners following a drowning is heightened where state safety features were omitted.
