The barrier must isolate the pool from the home and from the rest of the yard. Menifee does not relax this standard.
Cal. H&SC §115922(a) requires new permitted single-family residential pools to include at least two of seven drowning-prevention features. If the homeowner chooses an isolation fence as one of those two features, it must meet §115923: minimum 60 inches high, gaps not allowing a 4-inch sphere to pass through, no more than 2 inches of ground clearance, and self-closing/self-latching gates with the release at least 60 inches above the ground or otherwise inaccessible to small children. Alternatively, removable mesh fencing meeting ASTM F2286 with a self-closing, self-latching gate qualifies. Fence location must also comply with MMC Title 9 Development Code setback and accessory-structure standards for the underlying zoning district. HOAs in Menifee's master-planned tracts (Audie Murphy Ranch, Heritage Lake, Menifee Lakes, etc.) may impose additional aesthetic standards, but Civil Code §714 and §4716 prevent HOAs from blocking compliant safety barriers.
Failure to install a code-compliant pool barrier where required is a code violation enforced under MMC Title 15 and can trigger building permit denial, occupancy/final-inspection hold-up, code enforcement citations, and potential civil liability under California premises law if a drowning occurs.
