The Florida Residential Swimming Pool Safety Act in Chapter 515 of the Florida Statutes applies countywide. Section 515.27 requires every new residential pool, spa, or hot tub to have at least one of four safety features: a code-compliant barrier under Section 515.29, an approved power safety cover meeting ASTM F1346, exit alarms on doors and windows that provide direct access from the home to the pool, or self-closing and self-latching doors with releases at least 54 inches above the floor. Section 515.33 requires pool contractors to provide buyers with a drowning-prevention publication. Pinellas County building inspectors verify the chosen feature at final inspection, and code enforcement responds to complaints about failed barriers.
Operating a residential pool without a compliant safety feature is a second-degree misdemeanor under F.S. 515.29(4), in addition to local code enforcement actions and potential civil liability.
