Summary

A Knoxville business that could be taxed under two or more license-tax categories pays only the highest applicable tax, not a tax under every category it might fit.

Each person engaged in a single business, which business might fall under two (2) or more sections of this chapter, shall pay the highest tax imposed by such sections, but only one (1) tax. This provision shall not be construed to permit any person to exercise two (2) or more taxable privileges by the payment of only one (1) tax.

Full Breakdown

Knoxville, Tennessee's business license tax chapter declares dozens of occupations taxable privileges, each carrying its own privilege tax rate. Where a single business could fall under two or more of those tax sections at once, Sec. 16-7 resolves the overlap: the business owes only the single highest tax among the applicable sections, not a stacked total. The provision is explicit that this doesn't let a business avoid separate privilege taxes for genuinely separate business lines -- it applies only when one business activity happens to fit more than one classification. The tax is paid to the city director of finance under Sec. 16-5.

Violations & Fines

Operating a classified business in Knoxville without paying the applicable privilege tax is a misdemeanor under Sec. 16-8, punishable per the general penalty in Sec. 1-9.

Frequently Asked Questions

If my Knoxville business fits two tax categories, do I pay both?
No -- Sec. 16-7 requires payment of only the higher of the two applicable privilege taxes, not both, as long as it's genuinely one business.
Does this rule let a business skip taxes on a second business line?
No -- Sec. 16-7 says it doesn't permit exercising two or more separate taxable privileges by paying just one tax.
