Summary
Redding bans the retail sale of all flavored tobacco products citywide under Municipal Code Section 6.13.040(J), adopted in August 2025. Any tobacco product marketed with language suggesting a taste, odor, or cooling sensation other than tobacco itself is presumed flavored, and selling it puts a retailer's city tobacco license at risk.
J.Flavored tobacco products.(1)It shall be unlawful for any tobacco retailer to sell any flavored tobacco product.(2)Presumptive flavored tobacco product. There shall be a rebuttable presumption that a tobacco product is a flavored tobacco product if a tobacco retailer, manufacturer, or any employee or agent of a tobacco retailer or manufacturer has taken action directed to consumers that would be reasonably expected to cause consumers to believe the tobacco product is a flavored tobacco product. Any communication by or on behalf of the manufacturer or retailer of a tobacco product that such tobacco product imparts a taste or odor other than the taste or odor of tobacco, and/or that imparts a heating, cooling, or numbing sensation, constitutes presumptive evidence that the tobacco product is a flavored tobacco product. This includes but is not limited to public statements that a product is flavored, such as describing the product as 'chill,' 'ice,' 'fresh,' 'arctic,' 'sweet,' 'spicy,' or 'frost.'

Full Breakdown
040(J)(1) makes it unlawful for any tobacco retailer to sell a flavored tobacco product anywhere in the city, without carving out an exception for menthol or any other specific flavor category. Because proving a product's actual chemical flavoring is difficult, subsection (J)(2) creates a rebuttable presumption: a tobacco product is treated as flavored if a retailer, manufacturer, or their employee or agent has taken any action directed at consumers that would reasonably lead them to believe the product is flavored. Marketing language claiming the product imparts a taste or odor other than tobacco, or a heating, cooling, or numbing sensation, counts as presumptive evidence of a flavored product, and the code specifically calls out descriptive terms like 'chill,' 'ice,' 'fresh,' 'arctic,' 'sweet,' 'spicy,' and 'frost' as red flags.
13, adopted by Ordinance No. 2681 on August 19, 2025, which also requires every tobacco retailer to hold a city tobacco retail license, verify buyer age at twenty-one with photo identification, and prohibits self-service tobacco displays. 110 makes any chapter violation grounds for license suspension, starting at fourteen days for a first offense within a five-year window and escalating to revocation on a third.
Violations & Fines
Selling flavored tobacco is a straight violation of Chapter 6.13, punishable by license suspension: fourteen days for a first violation at a location within five years, thirty days for a second, and revocation on a third (§ 6.13.110(A)(1)-(3)). Violations can also be prosecuted as an infraction or misdemeanor and carry a civil administrative penalty of at least one thousand dollars per violation, with each day of continued flavored-product sales counted as a separate violation (§ 6.13.130(C), (H)).
