Charlotte, NC Trash & Recycling: Bin Placement Rules (2026)

Section 10-31(a) of the Charlotte City Code governs the small waste container, the city-issued receptacle that Solid Waste Services (SWS) provides to detached single-family homes, accessory dwelling units, and small waste container-eligible developments. That term means 29 or fewer residential units approved before January 1, 2018, or 11 or fewer units approved after that date. The timing rule is the same for each of those households: the container goes to the curbside no earlier than the day before collection and no later than 6:00 a.m. on collection day, and it comes off the curb by 11:59 p.m. that day. Small business garbage service under section 10-30(b) runs on the identical window. Businesses in Special Tax District #1 under section 10-30(c) get a later clock: the container must be at its designated location by 7:00 a.m. and any container left at the curbside must be removed by 5:00 p.m.

Placement has its own geometry. The container must sit at ground level, within six feet of the curbside, and at least three feet away from other containers and from obstacles such as mailboxes, telephone poles, automobiles, bulky waste, and trees, unless the SWS department head (the director of solid waste services) specifies another location. The code defines curbside as the portion of premises adjacent to or adjoining a roadway. Residents are told to use reasonable care and to avoid interfering with sidewalk access for others.

Crews skip a container when they would have to unlock or open a door, face a locked gate without the access code, meet a vicious or aggressive animal, find the container blocked by parked vehicles or equipment, climb or descend multiple steps, or see damage that prevents collection. Garbage must be drained of all liquid and sealed in securely tied plastic bags before it goes into the container, and the code bars using a small waste container for anything but its intended use.

Personal waste containers, meaning any receptacle that is not city-issued, follow the same 6:00 a.m. and 11:59 p.m. deadlines and the same six-foot and three-foot spacing under section 10-31(b). Large waste containers that can be rolled out follow those rules too under section 10-31(c). Ordinance No. 1111, adopted April 13, 2026, is the latest amendment to this section.
