Summary

In unincorporated York County, dumpsters serving qualifying commercial buildings must be screened or placed so they cannot be seen from any street or sidewalk next to an active building wall. The duty attaches to buildings on arterial roads, in designated town centers, over 5,000 square feet, or inside developments whose combined floor area tops 20,000 square feet.

City-specific rules exist: Rock Hill has its own dumpster rules rules that differ from York County's county-level regulations. If you live in Rock Hill, check the city-specific page instead.

Full Breakdown

790, part of the Unified Development Code's building design standards, folds dumpster placement into the county's mechanical and utility equipment screening rule. Subsection (B)(4) requires that all rooftop mounted mechanical equipment, loading docks, and dumpsters be screened or located so they are not visible from any point on a street or sidewalk adjacent to an active building wall. The duty is not universal: under subsection (A)(1) it reaches only buildings located on an arterial road, buildings inside an area the future land use map designates as a town center, any building with more than 5,000 square feet of gross floor area, or any building of any size sitting in a development whose combined building area exceeds 20,000 square feet.

Subsection (A)(2) exempts exterior mechanical equipment tied to an industrial use, but the exemption names mechanical equipment, not dumpsters, so a dumpster at an otherwise-covered commercial site still needs screening even if nearby industrial equipment does not. Compliance runs through the York County Planning and Development Services Department during site plan and building permit review; an applicant adding a dumpster pad shows the enclosure or placement on the submitted site plan so staff can confirm it meets the visibility test. The enclosure's location relative to the property line is separately controlled by the accessory-structure setback table for the applicable zoning district, so a dumpster pad must clear both the setback and the screening standard.

An owner who believes the standard creates a practical difficulty on an unusual lot can seek relief from the Board of Zoning Appeals rather than leave the dumpster unscreened.

Violations & Fines

Failing to screen a qualifying dumpster is charged as a zoning violation under § 155.9999 and is a misdemeanor under South Carolina law. The Zoning Administrator, the Planning and Development Services Director, the County Attorney, or County Council can bring an enforcement action, and violations are punishable by a fine of up to $500 per day the condition continues. The $500 cap applies to a continuous course of conduct only if the owner stops the violation after receiving notice and pursues any available administrative remedy.

Frequently Asked Questions

Does every business in unincorporated York County have to screen its dumpster?
No. The screening duty in § 155.790 applies only to buildings on an arterial road, buildings in a designated town center, any building over 5,000 square feet of gross floor area, or any building inside a development whose combined floor area tops 20,000 square feet. A small standalone shop outside those categories is not automatically covered.
What counts as adequate screening for a commercial dumpster?
The ordinance sets a visibility test rather than a materials list for dumpsters. Section 155.790(B)(4) requires the dumpster be screened or located so it is not visible from any point on a street or sidewalk adjacent to an active building wall, and Planning and Development Services confirms the proposed enclosure meets that test during site plan review.
What happens if a business ignores the screening requirement?
The county can charge the violation as a misdemeanor under § 155.9999 and seek a fine of up to $500 per day the dumpster remains unscreened. The Zoning Administrator, the Planning and Development Services Director, or the County Attorney can bring the enforcement action in county court.
Does this rule cover a temporary roll-off box on a construction site?
Section 155.790 addresses dumpsters, loading docks, and rooftop mechanical equipment tied to the qualifying building types, not a short-term construction roll-off box, so a temporary roll-off on an active job site is not governed by this particular screening standard.
