CVMC 8.24.040 bans dumping solid waste "upon or along the right-of-way of any public highway, street, lane, alley, or other public place within the corporate limits of the City," and the list of covered materials is broad: plastic, glass, metal, paper, recyclables, organic waste, other food waste, automobile parts, or liquid wastes of any kind. A companion section, CVMC 8.24.050, extends the same ban to private property, making it unlawful to dump on someone else's land, even land adjacent to a public street, without the owner's written permission. Chula Vista treats these as separate, standalone offenses from its litter provisions in CVMC 8.24.210, which cover paper, wood, glass, plastic, metal, or organic waste left on a street, alley, gutter, sidewalk, parkway, park, or recreational area.

Enforcement runs through the city's general penalty chapter, CVMC 1.20.010. Under subsection (A), any person violating a Municipal Code provision is guilty of a misdemeanor unless the City Prosecutor elects, at its sole discretion, to charge the case as an infraction instead. An infraction caps out at a $100.00 fine for a first violation with no jail time, while a misdemeanor conviction can bring up to six months in county jail, a $1,000 fine, or both. Subsection (E) makes each day a violation continues its own separate offense, so a pile left in an alley or right-of-way can generate a new count daily until it's cleared. Subsection (G) also deems any code violation a public nuisance, letting the City Attorney pursue civil abatement in addition to criminal charges. Code enforcement officers, authorized to issue notices of violation and administrative citations and to write misdemeanor citations under Penal Code Section 836.5, are the officials most likely to write these tickets in the field.
