In unincorporated Jackson County it is unlawful to dump, deposit, throw, or leave refuse on any road, street, or public or private property unless the site is a county-designated disposal location or the waste goes into a proper receptacle. Peace officers and the county marshal issue citations, and cases are tried in magistrate court with fines up to $1,000 and up to 60 days in jail.
(a)Limitations. It shall be unlawful for any person to dump, deposit, throw, or leave or cause or permit the dumping, depositing, placing, throwing or leaving of refuse on any road or street or any public or private property in the county, unless:(1)The property is designated by the state or the county or by any of their agencies for the disposal of refuse and the person is authorized by the proper public authority to use such property; or(2)The refuse is placed into a refuse receptacle, container, or dumpster installed on such property and designated for the disposal of refuse.
Full Breakdown
Sec. 32-52 sets the county's core illegal-dumping rule: refuse may only be discarded at a site designated by the state or county for disposal or placed in a receptacle, container, or dumpster installed for that purpose. The same section separately bars accumulating refuse or trash items that block storm drains or drainage ditches, and it declares any unpermitted accumulation of refuse on a lot, street, alley, or other public or private place a nuisance; an owner's failure to correct it after notice from the chairperson of the Board of Commissioners or a designee raises a presumption of intent to violate the article.
Enforcement runs through Sec. 32-23, which authorizes any state or county peace officer, the county marshal, or a Board-appointed designee to investigate reports of dumped refuse on private property and to issue citations for magistrate court. Sec. 32-24 adds two evidentiary presumptions useful to prosecutors: dumping from a moving vehicle, boat, or aircraft is prima facie evidence against the operator, and refuse found containing mail or papers bearing a person's name creates a rebuttable presumption that the named person is the violator. Penalties follow Sec.
1-12, the county's general penalty section: a fine up to $1,000, imprisonment up to 60 days, or both, with each day a violation continues counted as a separate offense.
Violations & Fines
A conviction is punished under Sec. 1-12 as directed by Sec. 32-24(d): a fine up to $1,000, up to 60 days in the county jail, or both. The sentencing judge may also order the offender to personally pick up and remove refuse from up to one mile of the public street, highway, or right-of-way where it was found, or from a private park or property with the owner's permission. Records of convictions are public, and a defendant who skips trial is arrested on a magistrate's warrant and must post bond for a future appearance.
