KPB 10.04.130(B) makes it a violation of Chapter 10.04 to throw, drop, discard, or otherwise dispose of municipal solid waste, other waste, or litter at a borough-owned solid waste facility, landfill, or transfer site outside a designated disposal area or dumpster established under KPB 10.04.110 and KPB 10.04.120, and it is a separate violation to dump the same materials on public rights-of-way or borough lands unless they go into a maintained receptacle. KPB 10.04.150 adds a standalone water-protection ban: it is unlawful anywhere in the borough to put, dump, place, or convey any refuse where the disposal would corrupt or impair water tables, streams, or water bodies.

Both provisions sit in the chapter the borough adopted after the cities of Soldotna, Kenai, Homer, Seward, and Seldovia transferred their solid waste disposal powers to the borough under KPB 10.04.080, so they reach dumping on borough lands and rights-of-way outside those cities. Under KPB 10.04.130(A), any violation of Chapter 10.04 is an infraction, cited on the Alaska Uniform Citation form; the minor offense penalty schedule at KPB 1.24.090 lists a $500 fine specifically for the littering and improper disposal offense at 10.04.130(B) and a separate $500 fine for unauthorized entry into a solid waste facility at 10.04.140(B).

Video surveillance at borough landfills, monofills, and transfer sites under KPB 10.04.120 is used to identify violators, and the registered owner of a vehicle caught on that surveillance is presumed to be the person who violated the code. Related equipment damage at a facility is a separate violation under KPB 10.04.170, billed at full repair or replacement cost.
