Chapter 6-10 of the Watsonville Municipal Code, effective May 26, 2022, is the City's local ordinance implementing SB 1383, the Short-Lived Climate Pollutant Reduction Act. Under § 6-10.102(a), single-family generators must subscribe to the City's organic waste collection service and use the blue, green and gray containers. Food waste goes in the green container with other source separated green container organic waste, recyclables go in blue, and gray container material stays out of both. The City can review the number and size of containers and require a household to adjust its service level.
Commercial businesses, which the chapter defines to include multifamily buildings, follow § 6-10.102(b). A multifamily dwelling with fewer than five units is not a commercial business. Businesses other than multifamily buildings provide labeled or color-matched containers wherever customers have disposal containers (restrooms excluded), inspect containers for contamination, and give employees, contractors, tenants and customers information every year. New tenants get education information before or within fourteen days of occupation.
Waivers exist. A de minimis waiver turns on organic waste falling below twenty gallons per week per container for a business with two cubic yards or more of weekly service, or below ten gallons for a smaller account. A physical space waiver needs documentation from a hauler, licensed architect or licensed engineer. Both need written re-verification every five years, and the City of Watsonville Solid Waste Division Manager decides them.
Tier one edible food generators (supermarkets, grocery stores of ten thousand square feet or more, food service providers, food distributors and wholesale food vendors) were required to comply from January 1, 2022. Tier two generators (restaurants with 250 seats or 5,000 square feet, hotels with 200 rooms, health facilities with 100 beds, large venues and large events) follow from January 1, 2024. Self-haulers must source separate and deliver organics to a recovering facility. City inspectors can inspect containers and collection loads at random but cannot enter the interior of a private residence.
Violations & Fines
A violation of Chapter 6-10 draws a notice of violation from the City Manager's enforcement official, with 60 days to comply except for generator container contamination. If the deadline passes, the City issues an administrative citation and fine. Penalties began January 1, 2024, after an education period. Section 1-2.109 caps administrative fines for infraction-level violations at $100, $200 and $500 for a first, second and third citation within a year. Recipients can request a hearing before a hearing officer, and the City can also bring civil action or misdemeanor or infraction prosecution.
