MMC Chapter 8.13, Organic Waste Disposal Reduction (Ordinance 2445, 2021), implements SB 1383. MMC 8.13.040 requires single-family organic waste generators to subscribe to the city's organic waste collection and properly separate materials, unless approved as self-haulers under MMC 8.13.100. MMC 8.13.050 imposes the same subscription and separation duties on commercial businesses, including multi-family premises, with de minimis waivers under MMC 8.13.060. MMC 8.13.070 requires tier-one commercial edible food generators (since Jan. 1, 2022) and tier-two generators (since Jan. 1, 2024) to arrange food recovery through a food recovery organization or service. The chapter also references AB 341 commercial recycling and AB 939 diversion mandates. Residential organics and recycling collection is provided through Athens Services.
Violations of Chapter 8.13 are enforced by administrative citation and fines under MMC 8.13.130. The city may inspect containers and loads (MMC 8.13.120). General code violations are also subject to civil penalties up to $1,000 per day (MMC 8.16.110).
