Summary

Cleveland County runs solid waste and recycling centers across the unincorporated county under Code § 11-40. Waste must go inside the marked container, not beside it, and residents cannot scavenge, climb on, or set fire to any container. Commercial, industrial, and institutional waste is barred outright, and breaking these rules is a misdemeanor carrying a $100 fine.

These county ordinances apply to unincorporated areas of Cleveland County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Solid waste/recycling centers are maintained at numerous sites throughout the county for the convenience of county residents, on land owned by the county. Solid waste may be deposited in the solid waste/recycling centers only in accordance with the provisions of this article.(b)All solid waste shall be deposited inside the solid waste/recycling centers in indicated containers. No solid waste shall be left at the solid waste/recycling centers outside of a designated container.(c)No person may remove any item from a solid waste/recycling center, climb on or into a designated container, or damage or willfully set fire to or attempt to set fire to contents of any designated container.(d)Commercial, industrial and institutional solid waste may not be deposited in the county-owned solid waste/recycling centers. ... (f)Fine for violation. Any person violating the terms of this section shall pay a fine in the amount of one hundred dollars ($100.00). A violation of this section shall also be punishable as a misdemeanor.

Full Breakdown

The Solid Waste Division maintains centers at numerous sites across unincorporated Cleveland County so residents have somewhere close to home to drop off garbage and recyclables, per § 11-40(a). Every load has to go inside the container marked for it; leaving bags or bulk items on the ground next to a container violates § 11-40(b) even if the center is otherwise open. Section 11-40(c) bans scavenging: no one may remove items from a center, climb into a container, or set or attempt to set a fire inside one.

Because these sites exist for county residents, § 11-40(d) shuts commercial, industrial, and institutional haulers out entirely; only residential loads are accepted. A parallel list in § 11-40(e) bars hazardous, liquid, infectious, and radioactive waste, dead animals, construction and demolition debris, and long lengths of cable or wire from every center, on top of the container rules. The solid waste director administers the article and can refer repeat violators for prosecution. Cleveland County keeps a separate sanitary landfill under § 11-39 with its own hours and accepted-waste list, so items rejected at a recycling center, like tires or asbestos, may still be taken to the landfill with prior written approval from landfill staff.

Violations & Fines

Violating any part of § 11-40, whether by leaving waste outside a container, hauling in commercial waste, or scavenging from a bin, carries a flat $100 fine under § 11-40(f) and is also charged as a misdemeanor. The solid waste director enforces the rules at each site and can bar repeat violators from using county centers.

Frequently Asked Questions

Can a contractor haul commercial waste to a Cleveland County recycling center?
No. Section 11-40(d) blocks commercial, industrial, and institutional solid waste from the county's recycling centers entirely; they're set up for residential use only, and haulers who bring commercial loads face the $100 fine and misdemeanor charge under § 11-40(f).
What happens if I leave my garbage bags next to the container instead of inside it?
That's a violation on its own. Section 11-40(b) requires all solid waste to go inside the indicated container, and anything left outside of one, even at an open center, breaks the rule and can draw the $100 fine.
Can I climb into a recycling center's dumpster to grab something I threw away?
No. Section 11-40(c) prohibits removing items from a center, climbing on or into a container, and setting or attempting to set a fire inside one, all under the same $100 fine and misdemeanor exposure.
