2-49 covers three distinct offenses tied to public and recycling containers. 2-59(b), in or around any public container or dumpster placed to control litter on public rights-of-way and city property. Second, it is unlawful to deposit unauthorized solid waste into or around recycling bins or containers that are part of a city recycling program, public or private, except for the specific recyclable materials those bins are designated to accept. Third, it is unlawful for anyone to remove recyclable materials from a recycling bin once they have been placed in or around it, which prevents scavenging of curbside recyclables.

2-4(d) separately directs that recyclable material accepted under a city recycling program, whether publicly or privately run, must be separated from other solid waste for pickup according to criteria the city manager or designee establishes, covering items like aluminum and steel cans, newspaper, glass, mixed paper and some plastics. 2-50, anyone who violates the chapter, including these recycling-container provisions, may be barred from future use of any recycling and RSA facility by the city manager or designee and may be charged a service fee or penalty; a violator can request an informal administrative hearing before a designated city officer, whose decision is final and not subject to further appeal.
