the evening before the scheduled collection day. The section flatly bars two things regardless of timing: putting recyclables in the street or on the sidewalks, and putting them out in plastic bags. Materials must sit in proper, durable, reusable containers instead. Commercial establishments on streets the City has designated for corrugated recycling are pulled out of the residential curbside system entirely by § 15:12-8, Private Collection: those businesses must use a private hauler, and any commercial account still getting City pickup on those designated streets loses it and must arrange private service going forward.

Once material is set at the curb, in a stored dumpster, or dropped at the City Recycling Depot, § 15:12-10 makes it the property of the City of Newark. Taking it back out is not a gray area: the ordinance makes it a violation for any person, firm or corporation, including a multi-family owner of four or more units, other than authorized City personnel or the City's designee, to collect or pick up that material, and each separate collection incident from one or more locations counts as its own distinct offense.

Enforcement authority sits with the Department of Public Works and any other city department empowered to enforce Newark's ordinances, which § 15:12-11 authorizes to inspect residential, commercial, industrial and institutional sites for compliance with the mandatory recycling ordinance at any time.
