Wylie, TX Tree Protection: Parkway Planting (2026)

Sec. 78-251 defines 'parkway' as the area between the street right-of-way line and the curb line, or, where there is no curb, the paved portion of the street or alley, essentially the strip that holds the sidewalk between the curb and the property line. Sec. 78-255(a) gives the public services director authority to plant, preserve, spray, trim, cable or remove any tree, shrub or plant on city-managed property, streets, alleys, public places and easements, and to remove anything unsafe, injurious to sewer or utility lines, or diseased.

Sec. 78-256(a) then grants the adjacent landowner a parallel right: while acting within the article, the owner of land next to a parkway may plant, remove, prune or spray trees in that parkway area, and subsection (b) notes that the parkway area not managed by the city is the adjacent owner's responsibility under article 7 of the planning and zoning ordinance. Subsection (c) draws the outer boundary of that right: other than the adjacent property owner, it is unlawful for any person to plant or set out, or to cause another to plant or set out, any tree or woody plant in a Wylie parkway without first obtaining the director's written permission.

New plantings must also respect Sec. 78-255(c)'s ban on landscaping that blocks vehicle or pedestrian passage or obscures a traffic-control device, sign or visibility triangle. Trees 16 inches or more in caliper, measured 4½ feet above ground, are automatically 'protected' under Sec. 78-253(c), which can further limit removal even by the adjacent owner.
