Full Breakdown
Chapter 54, Reuse Water and Cross-Connection Control, defines RECLAIMED WATER as water flowing out of the city's water reclamation facility and governs its distribution alongside backflow-prevention rules for the potable system. 04(A) makes connection mandatory, where available, for public, commercial, office, industrial, warehousing and multifamily property. Division (B) requires new single-family developments built after the chapter took effect to include reclaimed water distribution mains and connect once service is available, while division (C) leaves existing single-family connections voluntary but still subject to an availability charge.
Division (E) defines 'available' as contiguous to or within 100 feet of a property line, and division (F) gives property owners 90 days from the city's notification to complete a required connection. Division (G) bars reverting an irrigation connection back to potable water once tied into reclaimed water. Owners who face a unique, non-self-imposed hardship can seek relief from the City Manager under division (H), with a City Commission appeal available within 30 days of a denial. 05: a tapping fee plus meter set fee scaled to service size, for example $576 tapping plus $225 meter set for a 3/4-inch to 1-inch line, though first-time single-family connections and city-owned dual-check devices are installed at no cost to the homeowner.
Violations & Fines
Any person or customer violating Chapter 54 or a written city order is punishable under § 10.99 and must also pay the city's costs and expenses, including attorney's fees, per § 54.18(A). Each day a violation continues is a separate offense. Violators are additionally liable for the city's expenses, losses or damages, including the cost of correcting unauthorized work, tampering or system damage, under § 54.18(B), and the city can seek an injunction to stop the violation under § 54.18(C). The Pompano Beach Special Magistrate in Code Enforcement has jurisdiction over these violations under § 54.19.
