Full Breakdown

Sec. 090 is Eastvale's local implementation of California's density bonus law. A project qualifies by reserving at least 10 percent of its units for lower-income households, 5 percent for very low income households, building a senior citizen housing development, or dedicating 10 percent of a common-interest development to moderate-income buyers. 5 percent increment. Senior housing developments receive a flat 20 percent bonus. 5 spaces for four-or-more-bedroom units, on request. The city council is the approving authority, and the city and applicant must enter into a density bonus agreement.

Approval is not discretionary once the findings are met: the city must grant the density bonus, incentives and concessions unless it makes a written finding that a specific incentive is not needed for affordability or would cause a specific adverse impact under Gov. 5(d)(2). Additional bonuses stack for land donations, on-site child care facilities, and apartment-to-condominium conversions reserving units for lower-income buyers.

Violations & Fines

This section creates an entitlement rather than a prohibition, so there is no per-violation penalty. An applicant denied a density bonus, incentive or concession without the written findings Sec. 120.05.090(g)(2) requires may challenge the denial, and a developer that receives a bonus but fails to keep target units affordable for the required 30- or 50-year term is subject to enforcement of the density bonus agreement.

Frequently Asked Questions

How much of a density bonus can a developer get in Eastvale?
Up to 35 percent additional units. Sec. 120.05.090(d)(1) sets a 20 percent base bonus for qualifying lower- or very-low-income projects, adding 1.5 to 2.5 percent per extra percentage point of affordable units, capped at 35 percent.
Can Eastvale deny a density bonus request?
Only with written findings. Sec. 120.05.090(g)(2) requires the city to grant the density bonus, incentives and concessions unless it finds in writing that an incentive is not needed for affordability or would cause a specific adverse impact under state law.
How long must density bonus units stay affordable in Eastvale?
At least 30 years if the project receives only a density bonus, or 50 years if it also receives an additional incentive or concession, measured from the certificate of occupancy under Sec. 120.05.090(f).
