Summary

Escondido grants a density bonus above the otherwise-maximum residential density to housing developments of five or more units that set aside affordable, senior or student units. Sec. 33-1413 scales the bonus by income tier, from a 20% floor up to a 50% cap.

(a) The decision-making body shall grant one density bonus, as specified in subsection (b) of this section, and/or incentives or concessions, as set forth in section 33-1414, when a developer of a housing development of at least five units (or at least three units if the housing development is located within the South Centre City Specific Plan) seeks and agrees to construct at least any one of the following. (1) Low income households. A minimum of 10% of the total units of the housing development as restricted and affordable to lower income households, as defined in Health and Safety Code section 50079.5. (2) Very low income households. A minimum of 5% of the total units of the housing development as restricted and affordable to very low income households, as defined in Health and Safety Code section 50105. (b) Density bonus... The amount of density bonus to which a housing development is entitled shall vary... but shall not exceed 50% except in accordance with subsection (c) of this section or as otherwise authorized by State Density Bonus Law.

Full Breakdown

Article 67 (Sec. ) implements State Density Bonus Law, Government Code sections 65915-65918, and Sec. 33-1413 sets the local formula. Under subsection (a), the decision-making body must grant a density bonus, plus incentives or concessions under Sec. 33-1414, to a housing development of at least five units (three within the South Centre City Specific Plan) that commits to one of several affordability tiers: a minimum of 10% of units affordable to lower income households (Health and Safety Code Sec. 5), 5% affordable to very low income households (Sec.

50105), a qualifying senior citizen development, 10% moderate income units in a common interest development, 10% of units for transitional foster youth, disabled veterans or homeless persons, 20% lower income student housing, or a 100% lower income project. Subsection (b) sets the bonus itself: the amount varies with the percentage of affordable units provided above each minimum and cannot exceed 50% except as otherwise authorized by State Density Bonus Law. 5 percentage points of bonus for each added percentage point of low income units, reaching 50% bonus at 24% low income units.

5 points of bonus per added point, reaching 50% at 15% very low income units. Senior citizen housing developments receive a flat 20% density bonus. Table C covers common-interest moderate income projects, starting at a 5% bonus for the 10% minimum and adding roughly one point of bonus per added point of moderate income units. Density bonus units are excluded when calculating the development's target unit count, and any conflict between the article and state law is resolved in favor of state law.

Violations & Fines

This article is an entitlement and incentive program rather than a prohibition, so it carries no fine schedule of its own; a project's density bonus, incentives or concessions are conditioned on recording the required affordability restrictions and complying with the affordability tenure rules in Sec. 33-1418, and noncompliance can result in denial, modification or revocation of the density bonus approval and the associated affordable housing agreement required under Sec. 33-1420.

Frequently Asked Questions

How many affordable units does a project need for a density bonus in Escondido?
At minimum, 10% of units affordable to lower income households or 5% affordable to very low income households, per Sec. 33-1413(a). A qualifying senior citizen housing development, moderate income common-interest units, or set-asides for foster youth, veterans, homeless persons or students also qualify under the same section.
What is the largest density bonus Escondido will grant?
The density bonus cannot exceed 50% of the otherwise maximum density, except as further authorized by State Density Bonus Law, under Sec. 33-1413(b)(1). That ceiling is reached at 24% low income units under Table A or 15% very low income units under Table B.
Does a senior housing project get the same sliding-scale bonus as an affordable project?
No. Sec. 33-1413(b)(1)(C) sets a flat 20% density bonus for qualifying senior citizen housing developments or mobile home parks, regardless of unit count, rather than the sliding percentage tables used for income-restricted projects.
Do density bonus units count toward my project's affordable unit requirement?
No. Sec. 33-1413(a) states the density bonus units are not included when determining the total number of target (affordable) units required in the housing development; they are additional units granted on top of the base entitlement.
