El Monte's ADU/JADU Program Guidelines and Zoning Code reflect that ADUs are not subject to an owner-occupancy condition. JADUs, however, are governed by Cal. Gov. Code §65852.22(a)(2), which requires that the property owner reside on the property — in either the primary dwelling or the JADU — except when the owner is a governmental agency, land trust, or housing organization. Owner-occupancy for JADUs is enforced through a recorded deed restriction required by §65852.22(a)(5), filed with the Los Angeles County Recorder before final building permit sign-off.
Failure to record the §65852.22(a)(5) JADU deed restriction will block final inspection. Subsequent violation of the owner-occupancy covenant can trigger code enforcement and recission of JADU approval.
