7.8.3. Accessory Dwelling Unit (ADU)

A.Defined A small, self-contained dwelling unit located on the same lot as a principal residence.

B.Use Standards1.The design and size of the ADU must conform to all codes required for any new construction.2.The ADU must be a site-built structure. Mobile or modular structures may not be used as an ADU.3.Only one ADU may be created per principal dwelling unit.4.The ADU must be either:a.Detached in an accessory building; orb.Attached or within the principal dwelling unit but not accessible from the interior of said dwelling unit. Such ADU must have its own independent entrance.5.If not attached to the principal dwelling, the building containing the ADU must be located in the rear or side yard.6.No ADU may exceed 1,000 square feet in floor area nor be less than 300 square feet in floor area, excluding any related garage area or other ancillary storage. In addition to the above, no ADU may exceed the floor area of the principal dwelling nor have more than two bedrooms.7.The ADU must be constructed of materials similar in appearance to the primary residence.

Sec. " The use standards at Sec. B require the ADU to conform to all codes for new construction and be a site-built structure; mobile or modular units cannot serve as an ADU. Only one ADU may be created per principal dwelling unit, and it must either be detached in an accessory building, or attached to or within the principal dwelling without interior access, in which case it needs its own independent entrance. A detached ADU not attached to the main house must sit in the rear or side yard.

Floor area is capped between 300 and 1,000 square feet, excluding any garage or ancillary storage area, and the ADU can never exceed the floor area of the principal dwelling or contain more than two bedrooms; it must also be built of materials similar in appearance to the primary residence. The Sec. 1 Allowed Use Table lists ADUs as permitted (P) in the AG-1, AR-1, V-C, R-1-L, R-1, R-X and M-U districts, and not permitted in R-TF, R-MF, MHP, O-I, S-S, H-B, I-1 or I-2, so the unit is a by-right accessory use only in the county's agricultural, most residential, and mixed-use zones.

Violations & Fines

Building an ADU larger than 1,000 square feet, adding a second ADU on the same lot, or installing a mobile or modular structure as an ADU violates Sec. 7.8.3.B. Under Sec. 11.4.4, that is a misdemeanor punishable per Sec. 1.50.020 by a fine up to $1,000, up to six months in jail, or both, with each day of the ongoing violation counted as a separate offense, and the Building Official may deny occupancy until the unit conforms.
