Summary

Every business, trade or industrial building in unincorporated Hall County must provide off-street loading space sized per Table 8.1.3, on the same lot as the building, with at least 14 feet of overhead clearance, and loading areas visible from a road must carry a 10-foot landscape buffer under UDC Sec. 8.1.5.

These county ordinances apply to unincorporated areas of Hall County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Every building or structure used for business, trade or industry must provide space as indicated in Table 8.1.3 for the loading and unloading of vehicles. Off-street loading spaces must have access to a public alley or public street. The off-street loading spaces must be provided on the same lot as the structure they are intended to serve, and in no case may any off-street loading space be part of the area used to satisfy the off-street parking requirements of this section. Each space provided must have at least 14-feet of overhead clearance. All off-street loading areas visible from a public right-of-way must be screened with a landscape buffer at least 10 feet in width in accordance with Sec. 8.2.4.

Full Breakdown

UDC Sec. 3, with access to a public alley or public street. The loading spaces must sit on the same lot as the structure they serve and can never double as required off-street parking; each space needs a minimum of 14 feet of overhead clearance to accommodate delivery trucks. 3 sets the actual counts: commercial or retail buildings need one loading space at least 15 by 25 feet for every 20,000 square feet of floor area; industrial buildings need one space at least 15 by 50 feet for every 20,000 square feet; public schools need two spaces total, each at least 15 by 25 feet; and bus or truck terminals must provide enough space to hold the maximum number of buses or trucks loading, unloading or stored at the terminal at one time.

Any off-street loading area visible from a public right-of-way must be screened with a landscape buffer at least 10 feet wide, built to the same Sec. 4 standards that govern buffers between incompatible land uses elsewhere in the UDC, so loading docks facing a road cannot sit exposed without vegetative or structural screening.

Violations & Fines

Failing to provide the required loading space, using loading area to satisfy the separate off-street parking count, or leaving a road-visible loading area unscreened violates Sec. 8.1.5 and is enforced under Sec. 11.4.4 as a misdemeanor before the Magistrate or State Court of Hall County, punished per Official Code Sec. 1.50.020 with each day of noncompliance a separate offense, and the Building Official may withhold a certificate of occupancy under Sec. 11.4.3 until the site is corrected.

Frequently Asked Questions

Can a business use its loading space to meet its parking requirement?
No. UDC Sec. 8.1.5.B explicitly states an off-street loading space can never be part of the area used to satisfy the off-street parking requirements, so the two counts must be met separately on the same lot.
How big does a commercial loading space have to be in Hall County?
Table 8.1.3 requires one loading space at least 15 by 25 feet for every 20,000 square feet of commercial or retail floor area, with at least 14 feet of overhead clearance per Sec. 8.1.5.B.
Does a visible loading dock need screening?
Yes. Sec. 8.1.5.C requires any off-street loading area visible from a public right-of-way to be screened with a landscape buffer at least 10 feet wide, built to the Sec. 8.2.4 buffer standards.
