Full Breakdown
Watsonville Municipal Code Chapter 14-23 allows accessory dwelling units (ADUs) in all zones that permit single-family or multi-family dwellings or religious assembly uses, and junior accessory dwelling units (JADUs) in all zones that permit single-family dwellings. State ADU law governs, except where the City of Watsonville is more permissive. Section 14-23.030 sorts units into two tracks. State-exempt units must meet only the objective standards in California Government Code Section 66323, and the City cannot add development standards, design standards or discretionary review beyond them. Nonexempt ADUs follow Government Code Sections 66314 through 66332, and nonexempt JADUs follow Sections 66323 and 66333 through 66339.
The City's own larger allowance sits in Table 1 of Section 14-23.030(d), which applies to nonexempt ADUs on lots of 10,000 square feet or more in any residential district. A lot greater than 10,000 square feet can hold one ADU up to 1,200 square feet and one JADU. A lot greater than 12,000 square feet can hold one ADU up to 1,200 square feet, or two ADUs up to 750 square feet each for a combined maximum of up to 1,500 square feet, and one JADU. Building height follows Government Code Section 66321(b)(4), but Section 14-23.030(f) lets an ADU exceed that limit, with Table 2 printing 28' for the R-1, R-2 and RM-2/RM-3 districts, if one dedicated on-site parking space per ADU is provided.
If a nonexempt ADU is attached to or above an accessory structure rather than to the dwelling, that structure cannot contain restroom facilities, though it can have interior access to the ADU. Design standards for nonexempt ADUs in Section 14-23.040 require a deck or patio of at least 96 square feet with a minimum dimension of 8 feet, plus 20 square feet of landscaping, for each detached ADU on a single-family lot. Upper-floor windows facing an adjoining residential property are limited to clerestory or frosted glass. Newly built ADUs and JADUs follow the residential sprinkler rules of Chapter 8-11 unless the main dwelling needs no sprinklers. Section 14-23.110(f) bars any ADU or JADU in the R-1 or R-1P zone on a lot that already received an urban lot split under Chapter 13-13.
Violations & Fines
Chapter 14-23 prints no penalty of its own, so Title 1 applies. Under Watsonville Municipal Code Section 1-2.01, a misdemeanor conviction carries a fine of not more than $1,000 or up to six months in the County Jail, or both, and each day a violation continues is a separate offense. Any condition that violates the Code is also a public nuisance the City can abate. Section 14-23.100 lets owners of unpermitted pre-2020 ADUs ask the Building Official for a delay of up to five years if they apply before January 1, 2030.
