Chapter 17 of the Ashwaubenon Code is the Zoning Ordinance, adopted under Wis. Stat. Sec. 61.35 and Sec. 62.23. Sec. 17-3-200 defines 'Accessory Building' as a building subordinate and incidental to the main building on the same lot, and the Building Inspection Division's published Accessory Buildings handout treats sheds, tool sheds, decks, patios, and private garages as accessory buildings. Sec. 17-4-400 establishes the dimensional standards. In R-1 and R-2 districts, the total square footage of accessory buildings (including any tool shed) may not exceed 576 sq ft on lots under 15,000 sq ft when there is an attached one- or two-car garage, 768 sq ft on lots 15,000-25,000 sq ft, and 936 sq ft on lots over 25,000 sq ft. Maximum height is 15 feet, with a 6-foot rear and side setback when there is an attached two-car garage and a 4-foot side setback without one. No accessory building may be constructed in a utility easement. The accessory building must be fastened in place to prevent displacement due to wind loads, and concrete work adjacent to the structure requires departmental approval. In the RE (Rural Estate) district, no accessory building may exceed 25 feet in height or the height of the main building, side walls are limited to 10 feet, doors are limited to 10 feet, side and rear setbacks are 10 feet, accessory buildings must be located in the rear yard, and they may occupy no more than 35 percent of the rear yard. Materials in RE must be 'substantially similar to those used in the main building with respect to texture, color and general appearance.' Sec. 17-4-400(D)(2) of the Zoning Code separately requires every single-family and two-family dwelling to have a private garage at least 12 by 22 feet. An Accessory Building Permit must be obtained from the Community Development Department (Village Hall, 2155 Holmgren Way, 920-492-2300) before installation. Floodplain provisions in Chapter 14 may apply if the lot is in a Floodway, Floodfringe, or General Floodplain District; the State Uniform Dwelling Code (Wis. Admin. Code Ch. SPS 320-325) governs construction methods. Wis. Stat. Sec. 66.1014 (short-term rentals) does not exempt accessory buildings from local zoning.
Constructing or maintaining a shed without an Accessory Building Permit, in excess of the Sec. 17-4-400 size or height limits, inside a utility easement, or in violation of the 6-foot rear/side setback (4-foot without a 2-car attached garage in R-1/R-2) or 10-foot setback in RE is a violation of Chapter 17. Sec. 17-9-200 of the Zoning Ordinance makes any non-conforming construction null and void and authorizes the Village Attorney to seek injunction, mandamus, abatement, or removal, with forfeitures imposed under the Sec. 1-1-13 bond schedule of the Village Municipal Court. Failure to anchor the structure against wind displacement may also be cited as a building-code violation by the Building Inspection Division.
