Under Cedar Park Code of Ordinances Chapter 11 (Zoning), Article 11.04, Division 6, one-story detached accessory buildings used as tool/storage sheds, playhouses, and similar uses do NOT require a building permit if the gross floor area is 80 square feet or less. Accessory buildings exceeding 80 sq ft accessory to a single-family residential use DO require a building permit. The total area of all accessory buildings cannot exceed 20% coverage of the back yard of a single-family residence, and each accessory building must not exceed the size of the principal building. For lots of five (5) acres or greater, the total square footage of all accessory buildings is capped at 4,000 sq ft. Accessory buildings under 180 sq ft require a minimum 15-foot setback from a side lot line adjacent to a public/private street and a 10-foot setback from a rear lot line adjacent to a public/private street. Accessory buildings or structures shall NOT be located in front of the principal building or use, and may not be rented, sublet, or sold separately from the entire property. Building permits are issued through the Cedar Park Development Services Department (450 Cypress Creek Road).
Construction or placement without a required permit, or failure to meet setbacks and coverage limits, is a violation of Chapter 11 enforceable through Municipal Court. Under §1.01.009 general penalty, zoning violations are Class C misdemeanors with fines up to $500 per day per offense (up to $2,000/day for offenses affecting health and safety under Tex. Loc. Gov't Code §54.001). The city may also issue stop-work orders and require removal or relocation of noncompliant structures.
