Hialeah, FL Accessory Structures: Shed & Carport Rules (2026)

Section 98-1670 bans free-standing prefabricated buildings citywide with one carved-out exception: prefabricated utility sheds on residential lots. Those sheds must have an exterior built entirely of metal and/or fiberglass, approved and constructed to Miami-Dade County Products Control Division standards where applicable and to the Florida Building Code or South Florida Building Code as adopted by the city; non-prefabricated sheds may instead use concrete block, stucco, or other approved materials under the same building codes. Every utility shed, prefabricated or not, is confined to the rear yard and must sit at least three feet inside the perimeter, and it cannot be placed within an easement reserved for public utilities, drainage, or wall maintenance; sheds on lots in the R-Z zero lot line district must also meet that district's own setbacks.

Subsection (b) caps floor area at 100 square feet and height at 8 feet, and requires the shed to sit on a concrete slab. It can be used only for storage, never as living quarters for people or animals, and no plumbing or utility service beyond electricity may be installed inside it. Subsection (c) requires a building permit from the building division before installation, which is separate from, and narrower than, the general accessory-structure cap in Sec. 98-1666 that limits any accessory building to 35 percent of the main structure's size or 500 square feet, whichever is smaller; a utility shed must satisfy both the 100-square-foot shed cap and the broader accessory-structure ceiling.
