Pole or post-frame style accessory structures are prohibited, and metal accessory buildings are limited to commercial and industrial districts. Accessory structures with an exterior door or opening greater than 6 feet wide must be served by a drive connected to a public right-of-way. Sheds, parking structures, outdoor storage and fences must observe a 75-foot setback from the ordinary high-water mark of any lake, stream, pond, or wetland under Rothschild's shoreland-wetland and shoreland setback rules. A zoning permit is required before construction or ground-breaking. Adopted under Wis. Stat. Β§ 61.35.
Chapter 590 of the Rothschild Village Code is the Zoning Ordinance, adopted by the Village Board under Wis. Stat. Β§ 61.35 (which incorporates the city zoning powers of Wis. Stat. Β§ 62.23). Article VI (Development Standards) governs accessory structures, including sheds. The Code provides: 'Accessory building square footage shall not exceed 80% of the total footprint of the primary dwelling unit. Additionally, in no case shall the height of the accessory structure exceed the height of the principal building.' On materials and design, Article VI states: 'Accessory structures in the construction or style of a pole or post-frame building shall not be permitted. Furthermore, metal buildings shall be limited to the commercial and industrial districts.' Article VI also imposes an access standard: 'Accessory structures with an exterior door or opening greater than six feet in width shall be serviceable by a drive that is connected to a public road right-of-way.' The Village's storage rule Β§ 590-96 requires that 'In all residential zoning districts, all materials and equipment shall be stored within a completely enclosed building or enclosed within a solid fence,' which makes a permitted shed the principal lawful storage location for residential equipment. The shoreland setback in Article VI provides: 'There shall be a minimum seventy-five-foot setback from the ordinary high-water mark of all lakes, streams, ponds, and wetlands to all buildings or accessory structures, such as sheds, parking structures, outdoor storage, and fences.' Permits are addressed in Article IX: 'No building or any part thereof shall hereafter be erected or ground broken for the same nor shall any person build or alter any structure in the Village of Rothschild without first obtaining a permit.' The Building Inspector/Zoning Administrator is designated under Β§ 590-99 to administer the Code. The Wisconsin Uniform Dwelling Code (Wis. Admin. Code ch. SPS 320-325) supplies the construction standards for one- and two-family dwellings and may apply to attached accessory structures. Marathon County floodplain rules and Rothschild's separate shoreland-wetland zoning chapter add overlay requirements for parcels near waterbodies. Wis. Stat. Β§ 66.1014 does not exempt accessory buildings on a short-term rental property from these standards.
Erecting a shed without a zoning/building permit, exceeding the 80% footprint cap, exceeding the height of the principal building, using a pole or post-frame design in any district or a metal building outside commercial/industrial districts, building within 75 feet of an ordinary high-water mark, or failing to provide a public-road-connected drive for a shed with a door wider than 6 feet are violations of Chapter 590. The Building Inspector/Zoning Administrator may issue stop-work orders, citations, and removal orders. Penalties run under Article XX of Chapter 590 and the Village's general penalty provisions, with continued violations referable to Marathon County Circuit Court for injunction and abatement.
