Summary
Antioch lets a member of a recognized racing pigeon club keep an unlimited number of banded racing pigeons or fancy birds, but only with a permit from the Animal Control Supervisor and only if the aviary meets five welfare and sanitation conditions in AMC § 6-1.602(G).
(G) Racing pigeons. A member of a recognized racing pigeon club may keep an unlimited number of banded racing pigeons or fancy birds upon obtaining a permit from the Animal Control Supervisor. (See § 6-1.601.) The keeping of such birds is subject to the following minimum conditions:
(1) Aviaries shall be of sound construction and properly maintained to conform with the surrounding area.
(2) The location is subject to inspection by the Animal Control Supervisor at reasonable times.
(3) Aviaries shall be cleaned regularly, maintained in a sanitary condition, and kept free of organic materials which may cause offensive odors or allow the propagation of flies and other insects.
(4) Feed shall be stored in containers which protect against rodents and insects.
(5) The cage size and specifications shall conform to the rules and regulations of the racing pigeon organization.
Full Breakdown
601. That permit process requires the Animal Control Supervisor to first find the birds will not harm the creature, cause a public nuisance or health hazard, or create an unreasonable noise or odor disturbance for neighbors. Holding the permit then binds the keeper to five ongoing conditions: the aviary must be soundly constructed and kept consistent with the surrounding area; the location is subject to inspection by the Animal Control Supervisor at reasonable times; the aviary must be cleaned regularly, kept sanitary, and free of organic material that causes odor or breeds flies and insects; feed must be stored in rodent- and insect-proof containers; and cage size and specifications must conform to the rules of the keeper's racing pigeon organization.
Because these conditions attach to the permit itself, failing any one of them gives the Supervisor grounds to revisit or revoke the exemption from the standard ten-bird limit.
Violations & Fines
Keeping racing pigeons or fancy birds beyond the ten-bird cap without this permit, or violating the aviary's sanitation, inspection, or feed-storage conditions once permitted, is enforceable as a misdemeanor under the citywide general penalty, AMC § 1-2.01, with each day of noncompliance chargeable as a separate offense and the birds subject to the same nuisance-abatement remedies as any other excess fowl.
