Sec. 8-5. - Acts prohibited; exception. (a)Within the areas designated by section 8-4 of this Code, it shall be unlawful to trap, hunt or molest in any manner, any bird or wildfowl, or to rob wild birds' nests or wildfowls' nests.(b)Notwithstanding the provisions of subsection (a) above, if any species of bird congregates in such numbers in a particular location that they constitute a nuisance or menace to health or property, then the proper health authorities of the city, county or state shall meet with the proper state or wildlife officials to discuss a humane solution to the nuisance or menace. If, as a result of the meeting, no satisfactory alternative is found to abate such nuisance, then such birds may be destroyed in such numbers and in such manner as is deemed advisable by the city.
