Pocatello, ID Animal Ordinances: Bird Protection (2026)

Section 12.36.100, titled Park Property, opens 'No person in any park shall' and then lists prohibited conduct toward park property, vegetation, and wildlife. Subsection C, Wild Animals, Birds And Zoo Life, makes it unlawful to hunt, molest, harm, frighten, kill, trap, chase, tease, shoot, or throw missiles at any animal, bird, or zoo-maintained wildlife anywhere in a City park, which the code defines as any municipally owned park, playground, recreation center, or other City-owned or City-used area devoted to recreation, excluding the Riverside and Highland municipal golf courses.

The same subsection separately makes it unlawful to remove or possess the young of any wild animal, the eggs or nest of any bird, or the young of any animal kept in the public zoo. Subsection C.2 additionally bars giving or attempting to give any animal, bird, or zoo wildlife tobacco, alcohol, or other known noxious substances. The prohibition sits alongside related park-property rules in the same section against damaging trees, shrubs, or lawns (subsection B) and polluting park fountains or ponds (subsection D). Any police officer enforcing chapter 12.36 may eject a person the officer reasonably believes is violating the chapter and may inspect, seize, and confiscate property used, or reasonably believed to be used, in the violation, under section 12.36.130. The current text traces to Ordinance 3021 (2019) and the earlier Ordinance 2290 (1989), consolidating the older Prior Code section 9-12-7.
