Pocatello, ID Animal Ordinances: Breed Restrictions (2026)

Section 6.04.050(A) makes it unlawful for an owner or custodian to allow an animal to commit conduct the chapter defines as dangerous, exposing the owner to a misdemeanor citation and letting the Animal Services Department seize and impound the animal pending adjudication; conduct is not deemed dangerous if the victim was committing a tort or trespass against the owner first. Subsection (B), Prohibited Animals, lists three conduct-based categories rather than any breed name: an animal with a known propensity to attack unprovoked or endanger people, other animals, or livestock unless restrained under Section 6.04.060; any animal used or trained for fighting; and any dog trained as an attack dog, except law enforcement dogs.

Because the definition runs on behavior and training rather than ancestry, a dog of any breed can be declared dangerous, and no breed is presumed dangerous or restricted from city limits. Once an animal is declared dangerous, Section 6.04.060 imposes real obligations regardless of breed: secure confinement in a locked enclosure at least six feet high, warning signage on the property, a microchip within five days of conviction, mandatory spay or neuter within 30 days, 24-hour notice to Animal Services of any escape, attack, relocation, sale or death, and an annual dangerous-animal registration certificate and tag obtained within 45 days and renewed by January 31 each year.

Section 6.04.050(C) and (D) authorize impoundment and, on a first or repeat conviction, court-ordered destruction of the animal, with the Office of the City Attorney able to request destruction at sentencing.
