Washington state law (RCW 16.08) preempts breed-specific legislation and requires jurisdictions to regulate dangerous dogs based on individual behavior, not breed. Kent mirrors this approach in KCC 8.03. A potentially dangerous dog is any dog that, when unprovoked, inflicts bites on a human or domestic animal either on public grounds or while off the owner property, or chases or approaches a person upon the streets, sidewalks, or any public grounds in a menacing fashion. A dangerous dog is any dog that has inflicted severe injury on a human without provocation, killed a domestic animal while off the owner premises, or been previously found potentially dangerous. Owners of dangerous dogs must maintain a proper enclosure, post warning signs, register the dog with RASKC, and carry a surety bond or liability insurance of at least $250,000. Violations include confiscation and misdemeanor charges. Pit bulls, Rottweilers, German Shepherds, and all other breeds are welcome in Kent as long as they comply with general animal control rules.
Failing to register a dangerous dog or comply with enclosure rules is a gross misdemeanor under RCW 16.08. Repeat bite incidents can result in euthanasia orders.
