(a)It shall be unlawful and a class B offense for any person to maintain any stable, dog kennel, chicken coop, dovecote, rabbit warren, yard or other establishment wherein animals are kept closer than 40 feet from any tenement or apartment house, hotel, restaurant, boarding house, retail food store, building used for educational, religious or hospital purposes, or residence other than that occupied by the owner or occupant of the premises upon which such animal is kept.

City Code § 5-11(a) makes it a class B offense to maintain a stable, kennel, chicken coop, dovecote, rabbit warren, or similar establishment housing animals closer than 40 feet to a tenement, apartment, hotel, restaurant, boarding house, retail food store, school, church, hospital building, or any residence other than the animal owner's own. Section 5-3 separately bars keeping swine in the city except in a stockyard awaiting transport, on a fully conforming unplatted agricultural (A-1) tract, or as part of a licensed veterinary operation. Section 5-10(b) permits pasturing herbivorous livestock on agriculturally zoned or unplatted, undeveloped land with the landowner's consent and livestock-grade fencing, and § 5-13 requires stables housing horses, mules, cows, goats, sheep, or fur-bearing animals to be built for sanitary upkeep, with a watertight manure receptacle if within 200 feet of a residence.
