Brookhaven, NY Animal Ordinances: Mandatory Spay/Neuter (2026)

Town Code § 23-9 requires the animal shelter to operate a spay-neuter clinic that alters every dog and cat it places for adoption, and directs the clinic to also alter dogs and cats already owned by Brookhaven residents "to the extent possible," a resident-pet service that depends on clinic capacity rather than a blanket owner mandate. For adoptions specifically, § 23-9B makes the requirement absolute: any adoptable dog or cat old enough to be altered must be altered before delivery to the adopter, with the alteration fee paid in full before the surgery.

If the animal is too young to be altered at adoption, § 23-9C requires the adopter to post a bond equal to the alteration fee, and the animal must then be brought back to the shelter's clinic for the procedure within six months of adoption, unless it dies or is surrendered first, in which case the bond is refunded. For resident-owned pets brought in under § 23-9D, the clinic will alter the animal only as its personnel and space allow and only once all fees are paid in advance, so there is no fixed deadline or fine tied to that portion of the program. Fees for altering both adopted and resident-owned animals are set and periodically amended by Town Board resolution.
