Section 10-29's irresponsible-owner designation is Escambia County's mandatory spay/neuter trigger. It applies to a person found guilty, regardless of adjudication, more than twice within a three-year period of any combination of nine listed chapter 10 offenses: vaccination (Sec. 10-8), licensing (Sec. 10-9), animal welfare/owners (Sec. 10-11), sale/trade/give-away (Sec. 10-12), disposition of impounded animals (Sec. 10-13), dangerous dogs (Sec. 10-15), poisoning animals (Sec. 10-16), cruelty (Sec. 10-17), or concealment from scientific experimentation (Sec. 10-20). S. Sec. S. Sec. 122. Once designated, subsection (c) gives the owner 30 calendar days from the designation, or from the most recent later conviction, to have every domestic animal they own spayed or neutered, microchipped, and brought current on rabies vaccination and county license, and the owner must register with DAW and pay an irresponsible-owner registration fee annually for three years.
During that three-year period the person may not become the new owner, caretaker or harborer of any additional animal. DAW makes the initial designation, mails written notice, and the owner has 30 calendar days to request a magistrate hearing before the designation becomes final; a final designation can be appealed to circuit court.
Violations & Fines
Missing the 30-day spay/neuter, microchip or license deadline after an irresponsible-owner designation is a fee-schedule violation under Section 10-22, and DAW can also seek a court injunction barring the person from owning animals in the county. Acquiring a new animal while designated is itself a violation of Section 10-29(e), independent of the sterilization requirement.
