Summary

Jonesboro caps a household at five dogs over three months old under Code Section 10-45. Finding more than five dogs on a property is treated as prima facie proof of a violation, and it is the owner, not the city, who has to prove some of the animals are puppies under the age cutoff.

Sec. 10-45. - Number of dogs regulated. It shall be unlawful for any person to own, keep or harbor more than five dogs over three months of age within the corporate limits of the city except that this provision shall not apply to proprietors of dog hospitals and veterinarians when such dogs are kept upon premises used by such dog hospital and veterinarians as their normal place of business. Keeping on the premises of the owner of more than five dogs shall be prima facie evidence of violation of this section and the burden of proof shall be on the owner to show the ages of such dogs.

Full Breakdown

Section 10-45 sets the citywide ceiling at five dogs over three months of age per household; dog hospitals and veterinarians are exempt for dogs kept on the premises of their normal place of business, but no other exemption is written into the section, so a private residence, rescue foster, or hobby breeder is held to the same five-dog cap. The section shifts the burden of proof once a sixth dog turns up: finding more than five dogs on an owner's premises counts as prima facie evidence of a violation, and it is up to the owner to show the ages of the dogs to prove some are puppies under three months and do not count toward the cap.

The rule sits alongside Section 10-10's broader five-animal-or-fowl limit that covers other pets and livestock, excluding cattle and horses, but dogs get their own dedicated cap and evidentiary rule in Section 10-45 rather than being folded into the general count. Every dog over three months also has to carry a rabies vaccination tag under Section 10-46, and any dog picked up without a tag can be treated as a stray and humanely destroyed within 24 hours if not reclaimed. 03, derived from Ordinance No. 2769.

Violations & Fines

Owning more than five dogs over three months old is enforced through the prima facie standard in Section 10-45: once a sixth dog is found on the property, the burden shifts to the owner to prove the extra animals are under three months old. Violations are prosecuted as misdemeanors in Jonesboro Municipal Court under the Code's general ordinance-violation penalties; the section carries no standalone fine of its own.

Frequently Asked Questions

How many dogs can I legally keep at my Jonesboro home?
Five dogs over three months of age, under Code Section 10-45. If animal control finds more than five dogs on your property, that is treated as prima facie proof of a violation, and you would have to prove some are puppies under the age cutoff to avoid a citation.
Does the five-dog limit apply to a home-based dog rescue?
Yes. Section 10-45 only exempts dog hospitals and veterinarians for dogs kept on their normal business premises; no exception exists for foster homes, rescues, or breeders operating out of a residence.
What proof do I need if I have six or more dogs?
You need to show the ages of the dogs. Once more than five dogs are found on a property, Section 10-45 makes that prima facie evidence of a violation and puts the burden on the owner to prove some are under three months old and do not count.
