Port Orange, FL Animal Ordinances: Pet Store Rules (2026)

Section 10-13(a) is the gatekeeper: any business selling or offering to sell an animal must be a licensed kennel or a pet store, which rules out selling animals from an unlicensed shop, a private stand or any other commercial premises. Section 10-13(c) then layers on four specific sale bans regardless of the seller's licensing status. No animal may be sold at a flea market, outdoor market, garage sale or yard sale. No animal may be sold after being decorated by tinting, dyeing, decaling, or otherwise altering it in an unnatural manner for promotional purposes, a rule aimed at practices like dyeing chicks or rabbits for holiday sales.

No chicken, duck or other fowl may be sold under three months of age, and no dog, cat, rabbit, guinea pig or ferret may be sold under eight weeks of age, both age floors tied to the animal's ability to be weaned and vaccinated. Section 10-13(b) caps private, non-store animal transactions too: a residential dwelling unit may give away or sell no more than 14 animals in a calendar year, matching the 14-animal household cap in § 10-12, regardless of how many adult animals the household actually keeps.

Any sale that breaks one of these rules is itself declared a violation of the chapter under § 10-13(d), separate from and in addition to the household pet-limit violation that keeping too many animals for sale might also trigger.
