Full Breakdown
Section 14-13 caps home-based sales: no person may sell or offer for sale from a residential dwelling unit more than 20 dogs or cats or two litters, whichever is greater, in a calendar year, or more than 20 other animals or one litter or brood from a single birth event. Subsection (b) confines commercial animal sales to a licensed kennel or pet store: no business establishment of any other kind may sell or offer to sell an animal. Subsection (c) sets outright sale bans regardless of venue or age: no animal may be sold at a flea market, outdoor market, garage sale or yard sale; no animal may be tinted, dyed, decaled or otherwise unnaturally altered for promotional sale purposes; chickens, ducks and other fowl under three months old cannot be sold; and dogs, cats, rabbits, guinea pigs and ferrets under eight weeks old cannot be sold.
Subsection (d) makes any sale that violates these limits a violation of Chapter 14, enforced through the animal control authority's citation process under Sec. 14-17 and punished as a civil infraction under Sec. 14-18. The ordinance regulates where, how and at what age animals may be sold, but it does not require pet stores to be adoption-only or bar them from selling dogs or cats sourced commercially.
Violations & Fines
Selling animals in violation of Sec. 14-13, such as from an unlicensed business, at a flea market, or under the minimum age, is a civil infraction under Sec. 14-18 with a maximum penalty of $500.00. An officer may issue a citation; unpaid citations or missed hearings can lead to a county court judgment or, for repeat offenses, mandatory court appearance.
