Full Breakdown

Section 34-618(b)(1) of the Land Development Code lists veterinary services and kennels among the uses permitted as of right in the C-2 commercial general zoning district, provided animals are housed in enclosed, soundproof buildings (per Florida Building Code). The C-2 list applies to uses not exceeding fifty thousand square feet in gross floor area for single or multiple use buildings or developments. A building or development that exceeds fifty thousand square feet of gross floor area is approved only through the section 34-622 planned unit development standards and procedures.

The code defines the use in section 34-300: veterinary services means any building or portion thereof designed or used for veterinary care, surgical procedures or treatment of animals, but not the boarding of well animals. Boarding is therefore handled through the kennel wording that sits beside veterinary services in the C-2 and CS lists.

Other commercial districts treat the use differently. Section 34-619(b)(2) permits veterinary services and kennels in the CS commercial service district, again provided animals are housed in enclosed, soundproofed buildings per the Florida Building Code, with the same fifty thousand square foot threshold. The C-1 commercial limited district, which is meant for commercial areas close to residential neighborhoods, lists a narrower use: veterinary services for animal specialties, grouped with business and professional offices in section 34-617(b)(1).

The kennel line matters for home pet owners too. Section 34-716(b) makes household pets a permitted accessory use in all zoning districts, but the number of pets over six months in age cannot exceed three, and the keeping of four or more dogs six months of age or older is considered a kennel. Hens as household pets are limited to five where permitted upon lands in the city.

The Planning and Development Department administers these use lists, and section 34-1202 sends violations to the special magistrate.

Violations & Fines

Operating a veterinary or kennel use outside the districts that list it, or without the enclosed soundproof building, is a Land Development Code violation. The planning and development department gives a first notice with a minimum of ten working days to correct, then a final notice of violation and a special magistrate hearing under section 34-1202, where the city proves the violation by a preponderance of the evidence.

Frequently Asked Questions

Where can a vet clinic open in Jacksonville Beach?
Section 34-618(b)(1) permits veterinary services and kennels as of right in the C-2 district, and section 34-619(b)(2) does the same in the CS district. Section 34-617(b)(1) lists veterinary services for animal specialties in C-1. Each is subject to the stated building conditions.
Does the building have to be soundproofed?
Yes in C-2 and CS. Both sections permit veterinary services and kennels provided animals are housed in enclosed, soundproof buildings, with the code adding per Florida Building Code. The CS section spells it enclosed, soundproofed buildings, and the condition applies to every animal housed.
Can a vet clinic board animals?
The definition in section 34-300 covers veterinary care, surgical procedures or treatment of animals, but not the boarding of well animals. Boarding falls under the kennel wording that C-2 and CS list next to veterinary services, with the same enclosed, soundproof building condition.
How many dogs can I keep at home before it counts as a kennel?
Section 34-716(b) allows household pets as an accessory use in all zoning districts, but the number of pets over six months old cannot exceed three. Keeping four or more dogs six months of age or older is considered a kennel.
