Eden Prairie, MN Building Safety: Building Permits (2026)

Section 10.06 of the Eden Prairie City Code, titled Building Permits Required, bars any person from erecting, constructing, enlarging, altering, repairing, moving, improving, removing, converting or demolishing any building or structure, or any part of one, including plumbing, electrical, ventilating, heating or air conditioning systems, without first obtaining a separate building or mechanical permit from the City for each building, structure or mechanical component involved. This general permit rule sits alongside Section 10.01, which adopts the Minnesota State Building Code by reference and assigns application, administration and enforcement of the Code to the City's Building Official and the Building Inspections Division; Section 10.01, Subd.

3 ties permit issuance and fee collection to Minnesota Statutes Section 326B.121 and requires a state surcharge under Minnesota Statutes Section 326B.148 on covered permits. Section 10.07, Permit Fees, provides that fees for every permit issued under Chapter 10, which may include a surcharge, are set by Council resolution and kept on file in the office of the Building Official, and are to be uniformly enforced. Chapter 10 also separately requires permits for moving buildings (Section 10.05) and for private water wells under the state Water Well Construction Code (Section 10.04), each with its own application process, but the general construction-permit duty in Section 10.06 covers any building or structure work in the City, residential or otherwise, unless a chapter-specific exemption applies elsewhere in the Code.
