Summary

Forsyth County requires a building permit before any building or structure is erected, moved, extended, enlarged, structurally altered, or converted from unfinished to finished space anywhere in unincorporated Forsyth County. Grading, excavation or filling a new lot for construction, and covering or concealing new interior space with wall coverings, also trigger the requirement before work starts.

These county ordinances apply to unincorporated areas of Forsyth County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

7-2.1 When Required. No building or other structure shall be erected, moved, extended, enlarged, structurally altered, changed from unfinished to finished space, nor shall any existing or new areas within structures or buildings be covered or concealed by wall coverings, nor shall any grading, excavation or filling of a new lot for the construction of any building or structure be commenced until the department has issued a building permit for such work.

Full Breakdown

1 bars work from starting until the Department of Building and Economic Development has issued a permit, covering everything from new construction to interior finish-out. 4 requires proof of an adequate water supply, either a purchased water meter or an approved on-site well. 5 requires an active land disturbance (site development) permit for commercial, industrial, or residential amenity-area projects, with narrow exceptions for work on an existing foundation, interior-only work, or projects the Director finds too limited in scope to need one. 6 must include a department-approved survey plat, the building's square footage and height, its location on the lot, the number of dwelling units if residential, and any information the department or Board of Commissioners requires.

7 requires proof of legal access via a recorded easement for lots not fronting at least 60 feet of dedicated public street. 12 requires the department to complete application review within three business days after plan review is satisfied, and any unsigned, undated permit is only preliminary and cannot be relied on. 13 sets the permit's life at 12 months from issuance, renewable once by application within three months of expiration and payment of a $100 renewal fee, with at least one passed inspection required first.

Violations & Fines

Building without the required permit exposes the work itself to a stop work order under Section 7-2.2 whenever the Department of Building and Economic Development or the Department of Engineering finds the county's erosion and sedimentation rules aren't being followed. Under Section 7-2.8, any false or untrue statement made to department personnel that results in a permit being issued voids that permit and every related certificate ab initio, and forfeits all fees paid. Section 7-2.9 likewise voids all permits, retroactive to the date of deviation, if the structure built differs in size, location, or other characteristics from what was submitted in the application.

Frequently Asked Questions

Do I need a permit to finish interior space in my Forsyth County home?
Yes. Section 7-2.1 covers changing space from unfinished to finished and covering or concealing new or existing interior areas with wall coverings, not just new construction, so interior finish-out needs a building permit from the Department of Building and Economic Development before work starts.
How long does a Forsyth County building permit stay valid?
It expires 12 months after issuance under Section 7-2.13. You can renew it once by applying within three months of expiration, passing at least one inspection first, and paying a $100 renewal fee; after that, a brand-new permit is required.
What proof do I need before Forsyth County will issue a building permit?
You need a Department of Environmental Health certificate approving the lot for sewage disposal (Section 7-2.3) and proof of adequate water supply, either a purchased meter or an approved well (Section 7-2.4), plus a survey plat and project details under Section 7-2.6.
Can Forsyth County void my building permit after it's issued?
Yes. Under Section 7-2.9, if what you build differs in size, location, or other characteristics from your approved application, the permit becomes void as of the date of that deviation, and any permits issued afterward are void from the start under Section 7-2.8.
