Summary

Indio treats decks and patios differently once they pass 4 feet in height: below that mark they get eased setback encroachment and skip the lot-coverage count, while taller or roofed patios face standard setbacks and count as building footprint.

Uncovered and unenclosed porches, landings, decks, patios, stoops, and similar features less than 4 ft in height ... May encroach to within 5 ft of property line ... Unenclosed and unroofed decks, patio slabs, porches, landings, and stairways less than four feet in height

Full Breakdown

UDC Table 3.02.03-1 gives 'uncovered and unenclosed porches, landings, decks, patios, stoops, and similar features less than 4 ft in height' generous encroachment allowances, letting them sit as close as 5 feet from the property line. The same features exceeding 4 feet, plus upper-level balconies and decks, keep tighter siting (3 feet side, 6 feet rear). Covered patios attached to the main structure get their own row, 4 feet front, 0 feet interior side, 6 feet rear, and may be covered but not fully enclosed. Separately, § 3.01.05(C)(1) excludes only unenclosed, unroofed decks and patios under 4 feet tall from the lot-coverage calculation; a roofed or taller deck/patio counts as building footprint. A City Building Permit is still required for the structure itself under the state-adopted Building Code that Chapter 151 applies citywide.

Violations & Fines

Building a deck or patio that ignores these setback or lot-coverage thresholds is a Unified Development Code violation, risking a stop-work order, permit denial, or a required modification or removal of the noncompliant structure.

Frequently Asked Questions

Does a low patio slab in my backyard need to meet the full setback?
No. Uncovered, unenclosed patios and decks under 4 feet high get relaxed setbacks, as close as 5 feet to the property line, under UDC Table 3.02.03-1.
Does a covered patio count toward my lot-coverage limit?
Yes. A covered patio attached to the main house is summed into building footprint under UDC § 3.01.05(C), unlike an uncovered deck or patio under 4 feet tall.
