Full Breakdown
Chapter 33 requires a permit for any work that must conform to the Uniform Code, Energy Code, Fuel Gas Code, Mechanical Code, Plumbing Code, Residential Code, Fire Code, or Existing Building Code, including construction, enlargement, alteration, improvement, removal, relocation, or demolition, plus installing a solid-fuel burning heating appliance, chimney, or flue in a dwelling unit; the Fire Marshal's Office schedules an inspection of solid-fuel devices before a certificate of occupancy issues. Section 33-3(B) exempts one-story detached sheds, playhouses, or similar accessory structures on one- or two-family lots or townhouses if gross floor area is 144 square feet or less, temporary movie/TV/theater sets, window awnings on one- or two-family dwellings, partitions under five feet nine inches, painting and similar finish work, listed portable equipment, in-kind equipment replacement, and repairs that do not affect the structural system, egress, or fire protection systems.
Applications must be in writing, signed by the owner or an authorized agent, and include the Tax Map number, occupancy classification, and at least two sets of construction documents showing egress and structural information, sealed by a licensed architect or engineer where required under Education Law Articles 145 or 147. A permit becomes invalid if work has not commenced within six months of issuance and expires entirely 12 months after issuance, though it can be renewed on payment of the fee set under § 33-18.
The Department of Code Enforcement, headed by a Director appointed by the City Manager, can revoke or suspend a permit issued on inaccurate information or where work violates the applicable codes.
Violations & Fines
Violating Chapter 33 or the terms of a building permit is punishable under § 33-17 by a fine of up to $1,000 per day of violation, plus a separate civil penalty of up to $1,000 per day recoverable in a City-initiated civil action. Code enforcement personnel may also issue a stop-work order under § 33-5, and the City may seek injunctive relief in Supreme Court to compel removal or correction of noncompliant work.
