Canyon County, ID Building Safety: Childcare Center Rules (2026)

Canyon County Code § 06-01-11, Adoption Of Codes, adopts the 2018 edition of the International Residential Code for One- and Two-Family Dwellings by reference, and specifically includes Appendix M, titled "Home Day Care - R3 Occupancy," applying it to the unincorporated areas of the county. That appendix supplies the construction and life-safety requirements, such as egress and fire-separation provisions for the R3 occupancy classification, that a home used for daycare must meet in addition to the county's zoning-side daycare standards. The building code and the zoning code cross-reference each other on at least one point: § 07-15-09(E), governing group daycare facilities and daycare centers, requires the outdoor play area's enclosing barrier to meet "the swimming pool barrier requirements of the Canyon County building code as set forth in chapter 6," tying the fencing standard directly back to this chapter.

Enforcement runs through § 06-01-15, which makes it unlawful to fail to comply with any provision of the building code chapter and directs the building official and designated agents to enforce it throughout unincorporated Canyon County, with violations punishable under the county's general penalty at § 01-01-07. Section 06-01-17 separately makes noncompliance with the article a misdemeanor punishable under Idaho Code § 18-113, prosecuted in the Magistrate Division of the Third Judicial District of the State of Idaho for Canyon County, with each day a violation continues charged as a separately punishable offense.

As with every other provision cited here, this building code chapter binds only unincorporated Canyon County property; a childcare facility inside Caldwell, Nampa or any of the county's other incorporated cities is subject to that city's own adopted building code, not this chapter.
