Irvine, CA Building Safety: Childcare Center Rules (2026)

Section 3-10-1 requires an applicant to secure a child day care center license from the California Department of Social Services, a conditional use permit, and a City of Irvine business license before operating, and it puts the Building Official in charge of confirming ongoing compliance. Outdoor play areas must meet state minimum area-per-child standards, but Irvine adds its own geometry rules: corners under a 90-degree angle, front setback areas, landscaped streetside setbacks, and space needed for required parking are all excluded from the outdoor-area calculation, and infant-toddler, preschool and school-age children each need their own separate play space.

Surfacing must mix pavement, wood chips or sand (or an equivalent fall surface), and grass, infant areas must be predominantly grass, plus a 10-foot-wide roofed patio, a minimum four-foot walkway for wheel toys, and a shaded sandbox of at least 100 square feet for preschoolers, with wood chips or sand at least eight inches deep under climbing equipment. Play equipment needs a six-foot fall zone plus an additional no-encroachment recovery area, subject to Community Development sign-off, and outdoor noise must stay within the limits set in Municipal Code Section 6-8-201 et seq.

Indoors, infant napping rooms are capped at 12 cribs with three feet between cribs and a ban on stacking cribs, diaper-changing areas need a sink and guardrails, toddlers need one training toilet per four children, and an isolation room with a partial-glass observation wall must be provided for sick children. Wall and fence heights follow the institutional-district standard in Chapter 3-35. A center that cannot meet these standards may apply for administrative relief under Chapter 2-2, except that Planning Area 4 (Lower Peters Canyon) follows state standards instead of several City subsections.
