Fire sprinkler requirements in the Town of Colonie are set by the New York State Uniform Fire Prevention and Building Code (19 NYCRR Part 1219, adopting the 2020 International Building Code and International Fire Code Section 903). The Town of Colonie applies 19 NYCRR Part 1219 (which adopts the 2020 International Building Code, International Residential Code, and International Fire Code with New York amendments) for all construction. Residential sprinkler history: the 2009 IRC Section R313 would have required sprinklers in all newly constructed one- and two-family dwellings, but New York amended R313.1 to make sprinklers in detached one- and two-family dwellings optional rather than mandatory. Common triggers include: Group A assembly occupancies above the 100 or 300 occupant thresholds in 903.2.1; Group B office buildings above 12,000 sq ft on one floor or 24,000 sq ft total in 903.2.2; all Group R-1 hotels regardless of size; all Group R-2 multifamily over 3 stories OR with more than 16 dwelling units; all Group R-4 (residential care/assisted living) facilities; all Group M mercantile above 12,000 sq ft on one floor or 24,000 sq ft total; any building where the highest occupied floor exceeds 55 feet above the lowest level of fire department access (high-rise). The Colonie Building Department (Memorial Town Hall, 534 New Loudon Road, Latham NY) issues building permits and reviews sprinkler plans through the New York Uniform Code permit process. Sprinkler drawings must be stamped by a New York-licensed Professional Engineer or Registered Architect, and the installer must hold a New York State Office of Fire Prevention and Control sprinkler-contractor qualification. Acceptance tests are witnessed by the Colonie fire code official under IFC Section 901.5. Existing buildings undergoing significant renovation, change of occupancy, or addition are subject to the New York-adopted International Existing Building Code (19 NYCRR Part 1222), which may trigger retroactive sprinkler requirements depending on the alteration level.
Installing or modifying a sprinkler system without a building permit is a violation of 19 NYCRR Part 1219 enforceable under Executive Law Section 382, with civil penalties up to $1,000 per day. Operating a building required to be sprinklered without functional sprinklers is an IFC Section 109 violation; the Colonie fire code official may issue a Notice of Violation and, for life-safety risks, an order to vacate. Disabling or tampering with a required sprinkler system is also a criminal offense under NY Penal Law Section 145.10 (Criminal mischief in the second degree) and possibly Section 240.20 (Disorderly conduct) or Article 145 endangering offenses.
