(a)An approved automatic fire protection sprinkler system, designed and installed to National Fire Protection Codes and Standards (NFPA), shall be provided for the following, new constructed buildings, major renovated buildings as defined in subsection (c), and existing structures due to a change in occupancy classification or requirement to comply with the city's nonconforming ordinance. ... (4)Residential: Single- and multifamily buildings as follows:a.Hotel/motel (NFPA 13).b.Lodging and rooming houses, board and care facilities, multifamily dwellings and townhouses shall comply with Section 903.3.1.2 of the International Fire Code (as adopted), and sprinklers shall be in accordance with NFPA Standards 13D and 13R, up to four (4) floors. ... c.One and two-family residential dwellings six thousand five hundred (6,500) square feet or more gross area under roof 2 shall comply with NPFA 13D. One and two-family residential dwellings under six thousand five hundred (6,500) square feet of gross area under roof 2 and not used as a child day care are exempt. These structures shall comply with the International Residential Building Code (as adopted).

Full Breakdown

Chapter 4 of Title V governs sprinklers in the City of Southaven. Section 5-76(a) requires an approved automatic fire protection sprinkler system, designed and installed to NFPA standards, in new constructed buildings, major renovated buildings, and existing structures that change occupancy classification or must comply with the city's nonconforming ordinance.

Assembly, mercantile, business, industrial, storage and mixed occupancies are covered at 8,000 square feet or more gross area under roof, and H-1 through H-4 hazardous occupancies are sprinklered regardless of size.

Subsection (c) defines major renovation as construction costing more than fifty percent of the estimated cost of reconstructing the entire structure, or work the building official and the appropriate fire official consider major. Under subsection (d), an addition that pushes gross area under roof above the listed square footage brings the entire building under that requirement. Subsection (e) applies the most stringent standard where requirements conflict.

Supervision is mandatory. Under subsection (g), the system is electrically monitored by an approved central station meeting NFPA 71, and a runner or technician must arrive at the protected premises within 1 hour after a signal. Subsection (m) requires a licensed contractor to install piping within the building and to a point five feet outside it.

Violations & Fines

Section 5-60 makes a violation of the adopted fire code a misdemeanor against the city, punishable by a fine of not more than $1,000 and/or imprisonment for up to thirty days, with each day after due notice a separate offense. Section 5-4 adds inspection penalty fees of $500.00 for Residential R1, R2, R3 and R4 occupancy, starting after a thirty-day follow-up inspection, with additional fees for every seven-day period until violations are corrected.
